The social status that lawyers enjoy is worth all the efforts that law students make to practice this profession. There are increasingly fewer students who are willing to follow this career path because they have to invest a lot of time and money to practice the legal profession. As a consequence, law students have to learn both the criminal and the civil laws before they graduate, but during their last academic year they have to get specialized in one of the two domains because, otherwise, it is impossible for them to have a good knowledge of the laws. Thus, lawyers may deal with criminal or civil cases.

Lawyers are divided into two major categories: solicitors and barristers. Solicitors offer legal consultancy to their physical or juridical clients, whereas barristers represent clients in court. Solicitors must provide barristers with all the information they need to know about their clients in order for the latter to win the law suit. As separate as these professions may seem in theory, in practice the role of solicitors and barristers are not very well delimited, especially after the new legislation of the 1990.

There are several steps that a student has to fulfill in order to become a lawyer. The Bachelors’ degree is the diploma that students receive at the end of the academic years enabling fresh graduates to follow the course of the Legal Practitioners’ or the Barristers’ Vocational Course. Once they finish this course, lawyers have the possibility to plead in court and they can apply for a training course at a law company where they will deal with their first law cases.

There are very few students that make it to the last stage of this career path and get the chance to practice law. Some universities disagree with these changes, but the majority considers them benefic because the legal system will thus, be greatly improved. Each country has its own legal system, even if they originated from the same source. For instance, most European countries base their legal systems on the principles of Roman law. However, they are far from being identical. Legislation differs, in the sense that in some countries certain behaviors or practices are legal, while in others they are not. The severity of punishment may also differ: for the same crime the sentence may differ in terms of years of detention, or the same offense may be punished by a fine in some states, while in others is punishable by jail.

British law is founded on the doctrine of the precedent, while in the United States it is encoded in the Civil and Penal Codes. Sometimes, when a British judge is faced with a new type of offense, in passing a sentence he establishes a new precedent, which may be construed, to some extent, as being part of the process of making new laws. This is indeed uncommon, but the reality is that the process of giving new laws is rather similar in the two countries: for a bill to become law, it must be passed in an identical form by the two legislative organs – the House of Commons and the House of Lords in Britain, and the House of representatives and the Senate in the United States.

There are also certain differences at the institutional level: in Britain there are special courts for some types of conflicts, such as industrial courts, which deal with disputers over contracts and sexual discrimination in employment matters, or the Family Division of the High Court, which grants divorces and deals with child custody matters. Also, the lawyers are divided into solicitors and barristers. Barristers argue the cases in front of a judge and have the right to be heard even in the highest courts. They are not paid directly by clients, bur are employed by solicitors. These ones do much of the initial preparation for the cases and also handle legal work that does not come before a court, such as drawing up wills and dealing with litigation which is settled out of court. But at the procedural level things are very similar: cases are decided by a jury and the defendants who are not satisfied with the jury’s decision may appeal to a higher court. In general, the same crimes are punished in a similar way, with minor differences.

The same differences and similarities can be observed in other legislative fields, such as car accident insurance. Although the third-party liability insurance is mandatory in most countries, its purpose being to protect the innocent victims by indemnifying them for the injuries suffered. However, everywhere in the world there are irresponsible persons who disregard the provisions of the law and do not take out such an insurance or, even worse, leave the place of the accident. These legislative differences are also manifested in other fields. For instance, if we examine the legislation referring to car accident insurance, we shall see that there are some common points, but also many differences. In general, there is one type of insurance – the third-party liability insurance – which is mandatory in most countries. In the United States the mandatory character may differ in some states. For example, in North Carolina a driver must take out a liability insurance in order to be eligible for a driving license. In Great Britain, for an extra fee, insurance companies offer Legal Protection Cover, that is, they will cover the legal costs in case the policy holder chooses to appeal to a road accident solicitor to make a compensation claim on his behalf.
